Scope of Application

These general terms and conditions of sale and use apply to all sales concluded via the website https://www.univers-tibet.com.

These General Terms of Sale are available and accessible at any time on the site, and shall prevail over any other contradictory version or document. They may be subject to subsequent modifications; the applicable version for any purchase shall be the one published on the site at the time the order is effectively validated by the customer.

Any modification to the General Terms of Sale shall be enforceable against customers upon publication on the site, and cannot apply to transactions concluded previously. In any case, the customer is invited to read the General Terms of Sale and Use carefully.

You acknowledge that, before placing your order, you have taken note of these General Terms of Sale and received communication of all information listed in Article L.221-5 of the Consumer Code in a readable and comprehensible manner. Validation of your order constitutes unrestricted acceptance of these General Terms of Sale.

Article 1: Sales Conditions

1. Identification and Customer Account

To use Univers-Tibet® services, you declare that you are at least of legal age in your country, state, or province of residence, or that you have provided us with your consent to allow any minor under your care to use Univers-Tibet®.

The customer has the option to register on the site when purchasing or beforehand, and to create their customer account by providing their email address, which will serve as their identifier. They are then asked to provide their first name, last name, password, postal address, and phone number.

Creating an account is not mandatory. The customer can act as a guest while still providing the necessary information (name, postal address, email) for processing their order.

The customer undertakes to keep their identifier and password confidential and forbids disclosing it to any person whatsoever. The customer is solely responsible for the use of their codes and access to Univers-Tibet®.

2. Ordering

By placing an order, you declare that you are acting exclusively for private purposes.

The ordering process is as follows:

  • Selecting products and adding them to the basket
  • Validating the contents of the basket
  • Transmitting necessary information for proper order processing or site identification via customer account
  • Choosing a delivery method
  • Choosing a payment method and accepting these General Terms of Sale
  • Payment validation

The customer may view the details of their order and its total price and correct any potential errors before confirming it to express acceptance by clicking the Pay Now button to validate payment.

After confirmation of their order, the customer will receive an order confirmation email within one working day.

Any order constitutes acceptance of the prices and product description.

3. Order Validation

The Pay Now button allows you to confirm your order, which then becomes final, concluding a sales contract. Automatic record systems are considered proof of the nature and content of the order. Univers-Tibet® confirms the acceptance of an order to the customer at the email address provided by them. The sale shall be concluded from the validation of the payment by Univers-Tibet®, i.e., from the date the payment is validated for orders paid online by bank card.

Univers-Tibet® reserves the right, in all circumstances, to refuse or cancel any order placed by a customer with whom there exists a dispute regarding payment for a previous order. Should an order not be accepted (particularly due to unavailability of one or more product(s), Univers-Tibet® will inform the customer by any means available.

4. Cancellation Before Order Processing

If you change your mind before your order is processed, we accept the cancellation.

Article 2: Products for Sale

The essential characteristics and price of our products are indicated on the pages containing detailed product descriptions in the online store.

1. Price

Prices are indicated in euros including all taxes (TTC), excluding shipping costs. The price includes the cost of the products, handling, packaging, and storage fees. Prices are subject to change at any time without prior notice, noting that items will be billed at the price in effect when the order is placed.

All orders are invoiced and payable in euros.

Delivery fees are automatically calculated on the site based on the delivery address and the amount of the order, according to the following scale:

The customer is informed of the amount before validating their order.

(1) Delivery in Metropolitan France only, Andorra, and Monaco. Departments/Regions and Over-Sea Collectivities (DROM-COM) are not included.

(2) Delivery in Europe: Austria, Belgium, Bulgaria, Croatia, Estonia, Finland, Germany, Greece, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Portugal, Slovakia, Slovenia, Spain.

2. Product Availability

As long as our offers and prices are visible on the site, they are valid. The availability indicated at the time the customer consults the site remains dependent on the stock status at Univers-Tibet®.

Only the permanent discontinuation of an item from our suppliers leads to its removal from our sales offering. Otherwise, a new order within a certain timeframe may still be possible.

3. Item Unavailability

If there is an unavailability of an ordered item, the customer will be informed by email or on the invoice for items shipped in the case of multiple items.

We draw your attention to the fact that we are exempt from delivering the ordered goods if the goods are unavailable.

The order will be cancelled entirely or partially, and we will refund you any sums already paid for undeliverable items.

4. Pre-orders

Upcoming products are offered on the site www.univers-tibet.com.

A pre-order is the opening of the reservation phase for an item, based on a release date announced by the publisher. This announced release date may be changed at any time by the publisher, who alone is responsible for marketing their product. In all cases, Univers-Tibet® endeavors to ship items reserved by customers as soon as the definitive sale date arrives, up to the stock provided by the publisher.

5. Shipping Costs

Product prices displayed on Univers-Tibet® exclude delivery costs. Depending on the amount of your order or the delivery method you have selected, delivery fees will be charged.

Payment for shipping costs will be collected at the time of purchase in the final amount of your order.

Shipping costs are free in Metropolitan France.

Shipping costs in Europe are €6.90.

It is possible to choose secured delivery:

France rate: €4.99

Europe rate: €11.90.

It is important to note the difference between shipping and delivery. Indeed, shipping corresponds to the action of sending out items from an order; delivery corresponds to transporting items and ensuring their routing to a destination address.

Article 3: Payment

  • By bank card (Visa, Eurocard/Mastercard) in the payment form provided during the ordering process (secure entry via SSL encryption), by providing the type of card, your card number without spaces between digits, the control number (located on the back of your card), and the expiry date.

  • Via PayPal Payment: you have different payment methods and may even benefit from installment payments by bank card.

Payment occurs on the secure bank servers of our partners. This implies that no banking information regarding you transits via the website www.univers-tibet.com.

Payment by bank card is completely secure. Your order will thus be registered and validated as soon as payment is accepted by the bank.

Information related to your order is subject to automated data processing managed by our banking partner. The purpose of this automated data processing is to determine a level of transaction analysis and to combat card fraud. The occurrence of non-payment due to fraudulent use of a bank card will result in the recording of the details related to your order associated with this default in a payment incident file.

Irregular or anomalous declarations may also be subject to specific processing. Univers-Tibet® reserves the right to verify the personal data provided by the customer and adopt all measures deemed necessary to confirm that the person whose bank account is debited is indeed the one who placed the order, in order to prevent any fraudulent payment.

This verification may take the form of a request for proof of identity and/or residence. Failure by the customer to respond to such a request within two days of the request made by Univers-Tibet® will automatically result in the cancellation of the concerned order, with no possibility of subsequent claim. Univers-Tibet® also reserves the right to directly cancel any order that presents one or more factors of risk related to fraudulent use of a bank card.

Article 4: Orders and Delivery Times

When you place an order from Univers Tibet®, the processing time is 1 to 2 working days, and the delivery time in Metropolitan France is between 2 and 4 days. For Europe, delivery times may range from 3 to 5 working days.

It is important to note the difference between shipping and delivery. Shipping corresponds to the action of sending out items from an order. Delivery corresponds to transporting items and ensuring their routing to a destination address.

We deliver to your home or relay point. The delivery time includes the time required for package preparation plus the transit time.

The customer is notified by email of their order's shipment. This email contains a link allowing them to know the various stages of the order's transit by the carrier.

Article 5: Withdrawal, Return, and Refund

Products provided by Univers-Tibet® are new and guaranteed against any defects. They are identical to those found in traditional retail and come from all referenced publishers and suppliers.

1. Right of Withdrawal

In accordance with Articles L.221-18 et seq. of the Consumer Code, the customer has a right of withdrawal period of fourteen (14) calendar days from the date of reception or collection of the item(s) to exercise their legal right of withdrawal without giving reason and thus notifying Univers-Tibet® of their intention to return the item(s).

If the items are subject to the legal right of withdrawal, the customer exercising this right (under the conditions provided in this article regarding the deadline and methods for returning the items) may obtain a refund for the returned articles.

If the fourteen (14) day period expires on a Saturday, Sunday, or public holiday or non-working day, it is extended to the following first working day.

2. Exercising Right of Withdrawal and Return Procedures

You must transmit your declaration of withdrawal clearly in electronic form, via our website. We will send you an acknowledgment of receipt of your declaration by email.

To respect the withdrawal period:

  • You must send us your declaration of withdrawal before the expiration of the 14 calendar days deadline,
  • The items must not have been used, opened, or damaged,
  • The items must be returned intact and unused in their original packaging. If applicable, the packaging must retain its original seal.

Exercising the right of withdrawal requires the customer to return or restitute the articles without delay, and at the latest within 14 calendar days from exercising their right.

In accordance with Article L.221-23 of the Consumer Code, return shipping costs are the responsibility of the customer.

No cash advance payments will be accepted, whatever the reason.

3. Inspection of Returned Items

Upon receipt of the package returned by the customer, Univers-Tibet® will inspect its contents and verify the condition of the returned articles. It is only after this inspection that a refund (or non-refund) will be made by Univers-Tibet®.

In the event of a refusal to refund, we will inform you by email (with photo evidence if necessary) of the reasons for our refusal to refund.

4. Exception to the Application of the Right of Withdrawal

In accordance with Article L. 221-28, paragraph 5 of the Consumer Code, the legal right of withdrawal is excluded in the case of sealed articles that have been opened after delivery or that cannot be returned for health or hygiene reasons.

5. Refund

If the right of withdrawal is exercised, Univers-Tibet® is required to refund the sums paid by the customer, free of charge, with the exception of return shipping costs. The refund must be made within a maximum period of 14 working days from the date of reception of the returned package(s).

The refund will be processed by Univers-Tibet®'s payment service provider after confirmation by Univers-Tibet® that the ordered item(s) have been returned, using the same payment method that the customer used for the initial transaction.

No cash advance payments will be accepted, whatever the reason.

Article 6: Legal Guarantees

1. Legal Guarantee of Conformity

Articles sold through Univers-Tibet® comply with current French regulations and have performance compatible with non-professional use. Sales made on the site www.univers-tibet.com are subject to the conditions of the legal guarantee of conformity provided for in Articles L.217-4 et seq. of the Consumer Code, as well as the legal guarantee against hidden defects established in Articles 1641 et seq. of the Civil Code.

They benefit automatically and without additional payment, independently of the right of withdrawal and in accordance with legal provisions:

  • The legal guarantee of conformity, for products that appear defective, damaged, or impaired, or do not match the order,
  • The legal guarantee against hidden defects arising from a defect in material, design, or manufacturing affecting the delivered products and making them unsuitable for use.

The conditions for this guarantee are detailed in the "Amicable Arrangement and Mediation" section of these General Terms of Sale.

2. Non-Conformity and Return Conditions

In the event of a defective or non-conforming article, the customer has 15 calendar days from receiving the items to request an exchange. If the fifteen (15) day period normally expires on a Saturday, Sunday, or public holiday or non-working day, it is extended to the following first working day.

The customer must first send proof of the detected defect(s) to contact@univers-tibet.com (description and attached photos).

The customer must return the items new or unused in full and in their original packaging, intact, accompanied by all possible accessories, user manuals, and documentation (imperatively in the original cellophane wrapping and with the corresponding invoice).

Return shipping costs to the address we indicate are the responsibility of the customer.

3. Transfer of Ownership

The transfer of ownership of the articles to the customer will only take place after full payment of the price by them, regardless of the delivery date of said articles. Conversely, the transfer of risks of loss and deterioration of the articles occurs upon delivery and receipt of the said articles by the customer.

Product descriptions in the Univers-Tibet® databases have been entered using information provided by the publishers. Univers-Tibet® is not responsible for the content of works and cannot be held liable to the customer for such content.

Univers-Tibet® disclaims all responsibility if the delivered article does not comply with the legislation of the country of delivery (censorship, prohibition of a title or author...). Univers-Tibet® is not responsible for the content of websites that hyperlinked from its own site may refer to.

Article 7: Data Protection

1. Ownership and Processing of Data

Univers-Tibet® is the producer and owner of all or part of the databases comprising its site. By accessing the site, the customer acknowledges that their personal data are legally protected, and specifically forbids extracting, reusing, storing, reproducing, representing, or keeping, directly or indirectly, on any type of medium, by any means and in any form, all or part quantitatively or qualitatively substantial, of the content of the databases to which they access.

By accessing the Univers-Tibet® website, the customer undertakes not to record or transmit files containing viruses or any other contaminating or destructive function, not to use false information or third-party information, not to damage the image of Univers-Tibet®, particularly in the context of reviews made on the site or on third-party sites, and more broadly, not to use Univers-Tibet® that could lead to any civil or criminal prosecution under applicable laws.

The customer undertakes to indemnify and guarantee Univers-Tibet® upon first request against any damage, loss, or loss of profit that it may suffer.

2. Personal Data

Under the law 78-17 of January 6, 1978, as amended by Law n°2018-493 of June 20, 2018, it is reiterated that the personal data requested from the customer by Univers-Tibet® are necessary both to guarantee them access to Univers-Tibet® services and for processing their orders. Univers-Tibet® undertakes to ensure the security of the personal data it keeps for the purpose of fulfilling and tracking orders. The processing of information provided to Univers-Tibet® meets legal requirements regarding personal data protection, and the information system used ensures optimal protection of this data.

The customer has, in accordance with current national and European regulations, a permanent right of access, deletion, modification, the right to portability, and restriction of processing concerning information about them, subject to Univers-Tibet®'s legal obligations.

In the context of an order placed by the customer on Univers-Tibet®, the personal data of the customer will be processed by Univers-Tibet®.

Your data is processed in the European Union, with exceptions. Should Univers-Tibet® engage a service provider located outside the European Union, rules ensuring the protection and security of your information will be put in place by Univers-Tibet®. The methods for processing and storing the data collected by Univers-Tibet® are detailed in our personal data protection charter, accessible at all times via the link https://www.univers-tibet.com/en/policies/privacy-policy.

The customer has the right to decide and control the use of their data and to request this at any time:

  • by email, via the contact form with their name, address, and/or an order number
  • or by mail accompanied by all sufficient information to prove their identity (email, order number, customer number, address…) addressed to: Univers-Tibet® Customer Service (Connection) 261 rue Paris 93100 Montreuil.

Univers-Tibet® will have a period of one month from the receipt of requests to respond to them.

In case of difficulty related to the management of their personal data, the customer has the option of contacting the National Commission for Information Technology and Civil Liberties (CNIL). Finally, if the customer finds that a breach of the General Data Protection Regulation occurred, they have the option of mandating an association or body mentioned in section IV of Article 43 ter of the 1978 computer and liberty law, to obtain redress before a civil or administrative court or before the national commission for information technology and liberties.

Article 8: Force Majeure

Univers-Tibet® cannot be held responsible for any inconveniences or damages inherent in the use of the Internet network, including service interruption or failure, external intrusion, or the presence of computer viruses, nor in cases of force majeure as defined by French jurisprudence.

Article 9: Amicable Settlement and Mediation

The applicable law is French law.

Under Article L. 612-1 of the Consumer Code, "Every consumer has the right to free access to a consumer mediator for the amicable resolution of any dispute they have with a professional." This applies to contractual disputes regarding the performance of a sales contract or supply of services between a consumer and a professional.

In case of difficulties, we invite you to previously contact our after-sales service using the contact form.

If your problem is not resolved, you may resort to the services of a mediator within one (1) year from the receipt of your request by the after-sales department, for the out-of-court resolution of the dispute. To this end, you can address yourself to the following mediation services:

Article 10: Autonomy of Clauses

If one or more provisions herein are deemed invalid or declared so by a final ruling of a competent court, the other provisions shall retain their full force and scope.

These conditions are subject to modification at any time without prior notice by Univers-Tibet®.
